How a property transfer works
Free first consultation
At least half an hour in person in Zlín or online. You tell us about the property and when the transfer needs to be completed.
Checking the property
We go through the Land Register extract, mortgages, easements, pre-emption rights and leases, so any problem comes to light before signing, not after.
Contracts and escrow
We prepare the purchase agreement and the escrow agreement, arrange the signing, and the buyer pays the purchase price into escrow.
Registration and payment
We file the application with the Land Register, follow the proceedings and release the money to the seller once the transfer is registered.

Where the money is until the transfer is registered
Attorney escrow
The buyer pays the purchase price into a special attorney account, where it is kept apart from the firm's own funds. We release it to the seller once the buyer is registered in the Land Register and any other conditions the parties agreed on are met. If the transfer does not go ahead, the money goes back to the buyer.
- The release conditions follow the purchase agreement
- Contracts, escrow and the Land Register application from one firm
- We follow the Czech Bar Association rules on escrow

Frequently asked questions about real estate
Short answers to what clients ask us most often. We look at your specific situation at the first consultation.
How does attorney escrow work?
The buyer pays the purchase price into a special account held by the attorney. The attorney releases it to the seller once the conditions in the escrow agreement are met, usually when the buyer is registered as the owner in the Land Register. If the transfer fails, the money goes back to the buyer. Escrow is governed by the Czech Legal Profession Act and the rules of the Czech Bar Association, and the money is kept separately from the attorney's own funds.
How much does attorney escrow cost?
We tell you the price of escrow in advance. It depends mainly on the amount held and on whether we are also preparing the purchase agreement and the application to the Land Register.
How is an application for registration in the Land Register filed, and how long does it take?
The application is filed with the Land Registry office on the prescribed form, together with the contract, and an administrative fee is paid. The office first sends out a notice that proceedings have started and may allow the registration no earlier than 20 days after that notice was sent. In practice, registration usually takes about a month, depending on how busy the office is. The buyer becomes the owner with effect from the day the application reached the Land Registry.
What should be checked before buying property?
The starting point is the Land Register extract (list vlastnictví). It shows mortgages, easements, pre-emption rights, bans on disposal and any plomba, a mark warning that other proceedings concerning the property are under way. We also check whether the seller is insolvent and whether a tenant lives in the property. A lease does not end with the transfer, and the new owner takes over the landlord's rights and obligations (Section 2221 of the Civil Code).
Can attorney escrow be used when buying with a mortgage?
Yes. The buyer usually pays their own part of the price into escrow, and the bank sends the loan money according to its own conditions, either into escrow or directly to the seller. The bank also requires a mortgage over the property, so the purchase agreement, the mortgage agreement and the escrow have to fit together. That is why we agree the procedure with the buyer's bank in advance.
Is real estate acquisition tax still payable?
No. Real estate acquisition tax was abolished in 2020, and today neither the buyer nor the seller pays it. The seller may, however, have to pay income tax on the sale if no exemption applies. That depends mainly on how long they owned the property and whether they lived in it, so it is worth checking with a tax adviser before signing.
